Alternative Dispute Resolution
If the parties involved in the dispute are willing to amicably resolve the matter, our business litigation lawyers can help negotiate through alternative dispute resolution. In fact, your business contract may require that you initially attempt mediation or arbitration prior to taking the issue to court.
Here is some additional information on the two methods:
Mediation
Theprocess of mediation involves the two parties within the dispute and a third-party mediator. The mediator is intended to be a neutral party who will listen to the arguments of both sides and facilitate a resolution that works for both parties.
If both parties can agree, they will then follow the terms set forth in the settlement agreement.
Arbitration
If your business contract includes arbitration provisions, this means that you give up your right to litigation and must rely on arbitration for a resolution. During this process, the disputing parties will appear before a panel of arbitrators. Each party will present their case as they would in court and the arbitrators will make a final binding decision on the matter.
