Texas Lawyer Publishes Employment Law Advice from Stewart Hoffer, Kasi Chadwick

HOUSTON – Hicks Thomas lawyers Stewart Hoffer and Kasi Chadwick, who advise small businesses and major companies, wrote a commentary offering tips to employers that was published recently by Texas Lawyer.

Headlined “How to Avoid Top 5 Mistakes Employers Make,” the article addresses everything from best hiring practices to picking the right litigation strategy when an employee files suit.

Among one of the many interesting insights from the article is this:

Defense lawyers often encounter evidence that the employer had multiple, valid reasons for discharging/disciplining an employee before the incident giving rise to the lawsuit, but the employer did not take action in an effort to ‘be nice.’ Bad idea. Juries expect employers to discipline employees who engage in misconduct and to keep contemporaneous records of those activities.”

Mr. Hoffer, a Hicks Thomas partner, has represented companies in trials across the country, achieving successful results in a variety of cases including noncompete and trade secrets disputes and commercial litigation. He is Board Certified in Civil Trial Law by the Texas Board of Legal Specialization. In addition, he has been recognized in Texas by Thomson Reuters Super Lawyers every year since 2003.

Ms. Chadwick, senior counsel at the firm, handles a variety of commercial and business litigation with a special emphasis on employer-related disputes. She regularly represents employers in pre-litigation investigations and is a presenter for groups such as the American Bar Association and Texas State Bar. She earned selection to the 2019 Texas Rising Stars list, which recognizes no more than 2.5 percent of lawyers in the state. She is Houston Young Lawyers Association Fellow, a distinction reserved for just 1 percent of lawyers in the organization.
