Extensive experience representing natural gas pipeline companies including United Gas Pipeline Company, Palo Duro Pipeline Company, United Texas Transmission Company, Lone Star Gas Company, El Paso Natural Gas Company, American Pipeline Company, and Transcontinental Gas Pipeline Company in gas contract litigation. Experience includes proceedings before The Texas Railroad Commission and FERC.
  • A.G. Services, Inc. v. Peat, Marwick, Mitchell Co. Represented client in malicious prosecution claim brought against it by accounting firm. Obtained judgment disposing of the claim and obtained affirmation of that judgment on appeal.
  • Chevron Inc. v. Southern Pacific Railroad, Inc ., In the United States District Court for the Southern District of Texas, Houston, Division. Counsel for railroad regarding the transportation obligations in a contract for carriage of polypropylene. Obtained a court ruling in favor of SP, greatly reducing the transportation obligations.
  • City of Modesto v. Dow Chemical Co., et al., In the Superior Court of the State of California, County of San Francisco. Counsel for R.R. Street in ongoing, industry-wide environmental contamination litigation against drycleaning chemical and equipment industry.
  • Enron Equipment Procurement Co. v. Siemens Westinghouse Power Corp., In the 113th Judicial District Court of Harris County, Texas. Counsel for Siemens defending claims arising from damage to generator. Issues involved risk of loss terms, apportionment of insurance obligations, and force majeure provisions. Conducted favorable settlement.
  • Jacobs v. Schweitzer, et al., In the 334th Judicial District Court of Harris County, Texas. Counsel for shareholder in dispute involving stock purchase agreement. Obtained a complete defense verdict.
  • Newby v. Enron Corp. et al. , In the United States District Court of the Southern District of Texas. Ongoing representation of Merrill Lynch in federal securities litigation arising from the collapse of Enron.
  • Novus International, Inc. v. Union Pacific Railroad, In the 239th Judicial District Court of Brazoria County, Texas. Counsel for railroad defending fraud and breach of contract claims arising from allegedly poor rail service to chemical company. Successfully defeated fraud claim in ten-day trial. On subsequent appeal, obtained a take-nothing judgment on all claims.
