Areas of Specialty: Commercial litigation with extensive experience in energy, patent, trademark and unfair competition litigation; Administrative and Regulatory litigation before state and federal agencies; entertainment law.
Representative Cases/Clients:
- Gas Pipeline Take or Pay Claims and Litigation. Counsel to pipeline companies defending take or pay claims and lawsuits relating to gas not taken. Successfully developed first marketing affiliate program used by natural gas pipelines to accommodate excess gas tendered.
- Severance Tax Litigation. Successfully defended interstate gas pipeline company against claims by Texas Comptroller that several tens of million dollars of natural gas severance taxes were due on gas contract settlement payments, including successfully proposing and obtaining adoption of an administrative tax regulation favorable to parties to gas contract settlements.
- Oil and Gas Contracts Litigation. Advised oil and gas producers and purchasers regarding oil and gas purchase and sale contracts, pipeline easements, landowner relations, joint ownership/development/construction agreements, and oil and gas accounting issues, including preparation of leases.
- Entertainment Law. Represented artist/performer in federal court copyright lawsuit, successfully obtaining favorable settlement prohibiting third party from further copying the client's music CD. Represented record company and performing artist in various contract and accounting matters, including preparation of contracts and manufacturing and distribution agreements.
- Patent Law. Successfully prosecuted patent applications relating to drilling tools and processes, and relating to non-oilfield technologies.
Accomplishments/Honors: Licensed to practice before United States Patent Office.
