- Allied Bank v. Duerr-Dealy. Counsel for bank in dispute over security interests; obtained judgment for bank in case of first impression alleging that wastewater capacity reservation was security for obligation to bank.
- Anadarko Energy Services v. Mountain Energy, In the District Court of Harris County, Texas, 234th Judicial District. Successfully defended Anadarko against bankruptcy trustee's claims of partnership. Simultaneously prosecuted claims against former owners of bankrupt entity for breach of contract and misappropriation of funds.
- Asbestos Products Liability Litigation. Counsel for multiple asbestos defendants, including all phases of litigation involving hundreds of Mesothelioma and asbestosis plaintiffs. Tried multiple cases to verdict and obtained no liability findings in all cases to date.
- Enron Capital v. KN Processing, Inc., In the United States District Court for the Southern District of Texas, Houston Division. Lead counsel for KNPI in dispute involving a propane “swap” agreement. Settled Enron's $33 million dollar damage claim favorably prior to trial with implementation of a revised swap agreement.
- Exxon Corp. v. King Ranch, Inc., In the 11th Judicial District Court of Harris County, Texas. Defended King Ranch in dispute regarding a lessee's right of access to the Ranch. After extensive discovery and prevailing in a venue dispute, concluded favorable settlement.
- George M. Construction, Inc. v. TJ&T Enter., Inc., In the 11th Judicial District Court of Harris County, Texas. Counsel for construction company. Obtained an injunction against former employees attempting to set up a competing company using protected trade secrets.
- In Re Liberty Seafood, In the Judicial 10th District Court of Galveston County, Texas. Counsel for individual defendants and restaurants in Bankruptcy Adversary proceeding that resulted in favorable injunction hearing and eventual dismissal by Plaintiff.
- In re Rapada Securities Litigation. Successfully settled securities fraud class action lawsuit and related individual lawsuit against large Houston-based law firm, arising out of a public offering and private placement of securities. Nominal settlement payment made.
- In re Taxable Municipal Bond Securities Litigation. Successfully defended securities fraud class action lawsuits against an indenture trustee. Case arose out of issuance of $1.8 billion of taxable municipal bonds. No settlement payment made.
- Internal Corporate Investigations . Conducted investigation of allegations of accounting fraud for a major public company and interacted with the SEC in connection with its investigation.
- Joe C. Norman v. Rotan Mosle et al. Counsel in jury trial against New York Stock Exchange Company that allegedly provided false inside information to plaintiffs. Obtained successful findings for client.
- OSCA, Inc. v. Atherton, et al ., In the 190th Judicial District Court of Harris County, Texas. Counsel for energy production company; successfully obtained injunction protecting client's trade secret information against former employees.
- Peoples Energy Production-Texas, L.P. v. Sierra 2002, et al., In the 93rd Judicial District Court of Hidalgo County, Texas. Counsel for energy producer in dispute over acquisition rights under an AMI agreement. Successfully defended breach of contract, tortious interference, and fraud claims on summary judgment; trial pending.
- Pharmaceutical Products Litigation. Represented plaintiffs in several personal injury and wrongful death cases arising out of the use of certain medications, including Fen-Phen and Rezulin.
- Ponder v. Rocky Mountain Resources, In the 55th Judicial District Court of Harris County, Texas. Obtained summary judgment dismissing plaintiff's claims of fraud, conspiracy, and breach of contract against three defendants arising out of oil and gas prospects in Colorado.
- Public Accountants Liability. Represented national accounting firm in federal, state, and regulatory venues on various alleged accountant liability issues and in Texas State Board of Public Accountancy hearing.
- R.R. Street & Co., Inc. v. Economy Controls Corporation, In the United States District Court for the Eastern District of Missouri. Lead counsel in prosecution of patent infringement claim on behalf of dry-cleaning equipment manufacturer against infringer. Concluded favorable settlement.
- Representation of Independent Directors. Counsel for Independent Director Committees of several public corporations.
- Securities Fraud Litigation. Counsel representing former officers and directors of public company sued in securities fraud class action filed by Milberg Weiss. Case dismissed and affirmed on appeal in the United States Court of Appeals, Fifth Circuit.
- Socorro Chavez, et al. v. Rheem Manuf. Co., et al., In the United States District Court for the Southern District of Texas, Galveston Division. Represented product manufacturer in cases involving personal injury claims arising from allegedly defective hot water heaters. Successfully obtained multiple dismissals. Concluded favorable settlements in remaining cases.
- Tejas Oil & Gas v. Amerada Hess, In the 11th Judicial District Court, Harris County, Texas. Counsel for pipeline company in dispute over pipeline's alleged inability to provide sufficient natural gas to meet customer's needs due to force majeure. At trial, obtained finding that pipeline's allocation of limited supply was reasonable, despite plaintiff's firm commitment for gas. Case affirmed after a successful appeal.
- U.S. ex rel. Johnson v. Shell, et al., In the United States District Court for the Eastern District of Texas, Lufkin Division . Counsel for two major oil and gas producers in case alleging the fraudulent underpayment of oil royalties to the federal government. Managed case through pre-trial discovery and motion stages before negotiating a successful confidential settlement for client.
- U.S. ex rel. Wright v. AGIP Petroleum Co., et al., In the Eastern District of Texas, Texarkana Division . Counsel for Burlington Resources Inc. in multi-billion dollar industry-wide case under the False Claims Act. Conducted defense of claims including alleged fraudulent underpayment of gas royalties and improper deduction of treating and transportation costs for coal bed methane gas.
- Wilson v. United Texas Transmission Co. Lead counsel in a suit brought by royalty owners against the pipeline purchaser of gas. Obtained summary judgment in the trial court, which was affirmed on appeal in the 13th Court of Appeals of Texas, Corpus Christi.
